Yasir Arafat?s Body Is Exhumed for Poison Tests

RAMALLAH, West Bank ? When Yasir Arafat, the longtime Palestinian leader, was buried eight years ago, people crowded the streets and the rooftops in a tumultuous outpouring of passion; the air here was thick and acrid as militiamen fired off their weapons for hours.

On Tuesday, as part of an inquiry into whether he was poisoned, Mr. Arafat?s remains were exhumed in a subdued, reflective atmosphere, with his people more fractured and less certain of their future than when he was alive.

Mr. Arafat died in a Paris hospital in 2004 at the age of 75, an event that was swiftly surrounded by contention and mystery. Israeli officials have categorically denied Palestinian accusations of involvement. And though lab test results are expected in about three months, according to experts, they may leave open more questions than they resolve about the Palestinian suspicions.

?Our people are convinced that Israel committed this act,? Tawfiq Tirawi, a Palestinian official who leads the Palestinian investigating committee, told reporters here in a news conference. ?We are seeking evidence.?

But many Palestinians here noted that even if traces of poison were found, it would be impossible for forensics experts to identify any culprits. Others have noted that only Palestinians had direct access to Mr. Arafat before his death, broadening the focus of blame for any possible poisoning.

The area around the tomb had been cordoned off for two weeks as laborers carefully removed layers of stone and concrete, and the mausoleum was shielded from view with huge blue tarpaulin sheets. Officials said that the final steps began at dawn and that a Palestinian doctor took samples from the remains on the spot, handing them to assisting French, Swiss and Russian forensic teams.

The tomb was then reclosed with a modest military ceremony, and fresh wreaths were laid.

The minister of health of the Palestinian Authority, Dr. Hani Abdeen, offered few details, saying that the remains were ?exactly in the state you would expect to find in a body that has been buried for eight years.?

Mr. Arafat became ill in October 2004 after being confined under an Israeli Army siege and virtual house arrest for more than two years in his Ramallah compound, as the violence of the second Palestinian intifada and the Israeli clampdown seethed. He was flown by helicopter out of his headquarters and transferred to a military hospital in Paris. When he died about two weeks later, no cause was announced.

Records eventually emerged showing that he had died of a stroke that resulted from a bleeding disorder caused by an underlying infection. The infection was never identified. The hospital found no traces of poisons it had tested for.

But in July, Mr. Arafat?s widow, Suha, called for an exhumation in an interview with Al Jazeera, the Arabic television channel based in Qatar, after it reported that Mr. Arafat might have been poisoned with polonium, a radioactive element associated with K.G.B.-style assassination intrigue. The report was based on what the news channel said was an in-depth investigation using some of Mr. Arafat?s personal effects, provided by Mrs. Arafat, including clothing he had worn just before falling ill, his toothbrush and his trademark black-and-white checkered headdress.

Doctors at the Institute of Radiation Physics at the University of Lausanne in Switzerland found what they said were unusually high levels of the highly toxic radioactive isotope polonium 210 on certain items but said his remains would have to be tested to determine whether he had been poisoned.

Mrs. Arafat followed the interview with Al Jazeera with a request that the French authorities open a murder inquiry. Mahmoud Abbas, the Palestinian Authority president and Mr. Arafat?s successor, called on Russian experts to help.

For decades, Mr. Arafat, popularly known as Abu Ammar, relied on both diplomacy and often bloody resistance. Many Israelis considered him an arch terrorist, even as many Palestinians saw him as a symbol of their unity and the embodiment of their cause.

On Tuesday, the Palestinians here struck nostalgic notes. Now bitterly divided, they are a people whose choices have become starker: In the West Bank, the Palestinian Authority says it is committed to a peaceful path of negotiations with Israel ? though after nearly two decades of intermittent talks, a state remains elusive. In Gaza, the rival Islamic militant group Hamas has been spearheading the path of violent resistance, including driving eight days of fierce fighting with Israel and then negotiating a cease-fire.

?Confronting the Israeli occupation is more important than digging up the grave of Arafat,? said Salim Bast, 60, a retired librarian in Ramallah. ?Our problem is still alive.?

SOFIA, Bulgaria (AP) ? Bulgaria is offering citizenship to foreigners ready to invest at least half a million euros ($650,000) in the Balkan country's ailing economy.

Under the newly approved amendments, the candidates would have to invest in a Bulgarian company involved in a high-priority investment project in industry, infrastructure, transport or tourism.

The investors are also required to have had a permanent residence status in the country for at least one year.

Bulgaria, which joined the European Union in 2007 and is the bloc's poorest member, is trying to reverse the severe drop in foreign direct investment from ?6.55 billion ($8.5 billion) in 2008 to ?1.75 billion ($2.3 billion) in 2011.

Marvin Miller dies at 95; baseball union chief led push for free agency

Nothing about Marvin Miller seemed feisty or controversial at first glance; the soft-spoken economist was a smallish man with gray hair and a tidy mustache.

But as a union leader, it was Miller who took on baseball's establishment in the late 1960s, eventually guiding players to an era of mega-salaries and free agency, thereby changing the landscape of American sports.

"Nobody realized how gargantuan the task was," he said years later. "Major league players were, at the time, truly brainwashed."

Miller died Tuesday at his home in Manhattan, several months after being diagnosed with liver cancer, his family announced. He was 95.

Historian Studs Terkel characterized him as "the most effective union organizer since John L. Lewis," the legendary mine workers leader. Hank Aaron, one of the game's most-prolific home run hitters, wrote that he "should be in the Hall of Fame [even] if the players have to break down the doors to get him in."

During Miller's tenure as head of the Major League Baseball Players Assn. from 1966 to 1982, average salaries rose from $19,000 to $241,000, in large part because he fought baseball's antitrust exemption and gave players the right to move from team to team.

"Marvin possessed a combination of integrity, intelligence, eloquence, courage and grace that is simply unmatched in my experience," said Donald Fehr, who later headed the players union. "Without question, Marvin had more positive influence over Major League Baseball than any other person in the last half of the 20th century."

But not everyone appreciated Miller. As basketball and football subsequently adopted free agency, fans saw higher ticket prices, work stoppages and a new order in which favorite players often switched teams.

"You may not like what he did," said David Carter, executive director of USC's Sports Business Institute, "but you can't argue with how he did it."

Before Miller's arrival on the scene, owners dominated the sport. It came as a shock when Dodgers stars Sandy Koufax and Don Drysdale held out for more money in 1966, the team eventually signing them for $125,000 and $110,000, respectively.

That same spring, the ineffective players union went looking for a leader and was referred to Miller.

Born April 14, 1917, he had grown up in Brooklyn, and his fondest childhood memories included Dodgers games at Ebbets Field, a short subway ride from home.

Miller received an early education in trade unionism from his father, a garment district salesman who organized fellow workers. After graduating from New York University, he worked for the New York City welfare department before taking jobs as an economist with the War Production Board and the War Labor Board during World War II.

"It was kind of like a utopian dream," he said of the latter board, created to handle disputes between management and workers. "And it worked remarkably well."

Miller subsequently moved to the United Steelworkers, where he spent 16 years as a research economist and, later, assistant to the president. In 1963, President Kennedy appointed him to a national labor management panel.

After the players union approached him, Miller made the rounds at spring training, facing opposition from wary players.

"The club owners are saying that you're one bad guy; they're saying terrible things about you," he recalled hearing.

Miller told them: "If I represent you and, at some point down the road, you begin to hear management people praising me, it's time to fire me."

Burning more calories is easier when working out with someone you perceive as better

ScienceDaily (Nov. 26, 2012) ? The key to motivation in physical activity may be feeling inadequate. One Kansas State University researcher found that those who exercised with a teammate whom they perceived to be better increased their workout time and intensity by as much as 200 percent.

Brandon Irwin, assistant professor of kinesiology, was the principle investigator in a study that tested whether individuals engage in more intense physical activity when alone, with a virtual partner or competing against a teammate.

"People like to exercise with others and make it a social activity," Irwin said. "We found that when you're performing with someone who you perceive as a little better than you, you tend to give more effort than you normally would alone."

For the first part of the study, college-age females exercise on a stationary bike six sessions in a four-week period. They told participants to ride the bike as long as they could. On average, each participant rode for 10 minutes.

Next, the same group of participants returned to the lab for more exercise sessions, but was told they were working out with a partner in another lab whom they could see on a screen. In reality, this was only a looped video. Participants also were told that their virtual partner was part of the first study and had ridden the bike approximately 40 percent longer than them.

"We created the impression that the virtual partner was a little better than the participant," Irwin said. "That's all they knew about their partner. In this group, participants rode an average of nine minutes longer than simply exercising alone."

While this 90 percent increase was promising, Irwin said he and his team had a hunch that the motivation could go even further. The participants were invited back to the lab for more exercise sessions with a virtual partner. This time, though, they were told they were on a team with their partner.

"We told them they were working together to achieve a team score," Irwin said. "The team score was the time of the person who quits first. The participants believed that in the previous trial, they didn't exercise as long as the other person. We created a situation where the participant was the weak link."

Participants in this team trial exercised approximately two minutes longer than simply working out alongside someone. However, Irwin added that the results look different over time.

"This was an average, but over time the difference got much bigger," he said. "In the beginning, the participants were exercising about a minute longer than the partner group. By the last session, participants in the team group were exercising almost 160 percent longer than those in the partner group, and nearly 200 percent longer than those exercising as individuals."

Irwin said this might be because those who believed they were exercising with a partner built a rapport over time and didn't want to let the partner down. He said the team was initially surprised at the drastic increase over time in participants working out with a teammate.

"If they're constantly working out with someone who's beating them, we wondered how motivated people would be to keep coming back and getting beat again," Irwin said. "It turned out to be exactly the opposite. Over time, it can be very motivating, as long as the conditions are right."

Irwin said research has shown that if an exercise partner or teammate is roughly at the same level or is exponentially better, the motivation disappears. He and his team found that a partner who worked at a level approximately 40 percent better was optimal.

"In certain fitness goals, like preparing to run a marathon, consider exercising not only with someone else, but with someone who is that much better," Irwin said. "For an extra boost, consider some type of team exercise that involves competition, like playing basketball at a regular time throughout the week."

In the future, Irwin wants to continue using virtual partners to increase the time and intensity of physical activity, but he hopes to move beyond false partners.

"I want to partner people up with actual individuals, not just prerecorded workout partners," he said. "Similar to matchmaking software for romantic relationships online, individuals from different sides of the country could be matched up based on their fitness goals and levels. Using technology, you could run with someone using your smartphones."

Irwin is currently researching this option and hopes to bring it to fruition within the next several years.

ScienceDaily (Nov. 26, 2012) ? You may have received CPR training some time ago, but would you remember the proper technique in an emergency? Would you know what to do in the event of an earthquake or a fire? A new UCLA psychology study shows that people often do not recall things they have seen -- or at least walked by -- hundreds of times.

For the study, 54 people who work in the same building were asked if they knew the location of the fire extinguisher nearest their office. While many of the participants had worked in their offices for years and had passed the bright red extinguishers several times a day, only 13 out of the 54 -- 24 percent -- knew the location.

When asked to find a fire extinguisher, however, everyone was able to do so within a few seconds; most were surprised they had never noticed them. The researchers found no significant differences between men and women, or between older and younger adults.

"Just because we've seen something many times doesn't mean we remember it or even notice it," said Alan Castel, an associate professor of psychology at UCLA and lead author of the study. "If I asked you to draw the front of a dime or the front of a dollar bill from memory, how well could you do that? You might get some elements right. Do you know who the president is? On the dime, is he facing left or right? Does it say 'In God We Trust' on the front of the dollar or the back? Do you know what else it says? You've seen it so many times, but you probably haven't paid much attention to it."

Castel said that not noticing things isn't necessarily bad, particularly when those things are not important in your daily life. "It might be a good thing not to burden your memory with information that is not relevant to you," he said.

But with safety information, such as knowing where fire extinguishers are or what to do in an emergency, being prepared can, of course, be very useful.

"When you're on an airplane, do you know where the life vest is and what to do in the event of an emergency?" Castel asked. "You've been told many times, but how would you respond under stressful conditions, when there could be smoke and people screaming?"

A few months after being asked the location of the nearest fire extinguisher, the study participants were asked again if they knew where the closest one was. All of them knew.

"We don't notice something if we're attending to something else," Castel said. "Fire extinguishers are bright red and very conspicuous, but we're almost blind to them until they become relevant."

What does this tell us about the importance of training, whether for emergencies or something as common as learning a new computer program?

Castel stresses that making errors during training is useful. As with the fire extinguisher exercise, errors -- or simple oversights -- can teach us that we don't know something well and need to pay more attention in order to remember it.

"It's good if errors happen during training and not during an event where you need the information," he said. "That's part of the learning process."

The study is published in the journal Attention, Perception, & Psychophysics.

Castel's co-authors are Michael Vendetti, a UCLA psychology graduate student, and Keith Holyoak, a UCLA professor of psychology. The study's participants work in UCLA's psychology building.

Carrier Pigeon Code From World War 2 Era Stumps English Spy Agency

A carrier pigeon's last wartime message has baffled the code breakers at Britain?s Government Communications Headquarters (GCHQ), the spy agency in charge of signals intelligence.

The message consists of 27 handwritten blocks of five letters each, Phys.org reports. The note was attached to a pigeon whose skeletal remains were recently found by retired probation officer David Martin while doing work on his house in Surrey, England.

The code was written on official stationery with the heading "Pigeon Service" and was discovered in a red canister attached to the bird's leg, Yahoo! reports.

Despite recent advances in cryptography, the simple message may prove indecipherable without the accompanying codebook that presumably would have been in the possession of the message's intended recipient, which is listed only as "X02" on the document.

"This means that without access to the relevant codebooks and details of any additional encryption used, it will remain impossible to decrypt," said a GCHQ spokesman, according to Yahoo!

During World War II, nearly a quarter-million carrier pigeons braved enemy hawk patrols and pot-shooting ground forces to deliver messages from various branches of the British military, including Britain?s Special Operations Executive, according to ABC News.

Stymied so far, the GCHQ has enlisted the Pigeon Museum at Bletchy Park--where mathematician Alan Turing famously helped crack German codes during the war--to trace the pigeon's identity. It is also seeking help from anyone who has information on the note's author, which is rendered in the coded message ?Sjt W Stot?, or its presumed recipient, ABC reports.

"Unless you get rather more idea than we have of who actually sent this message and who it was sent to we are not going to find out what the underlying code being used was," GCHQ historian Tony, who asked that only his first name be used, told the BBC.

According to the British news site, the best guess is that the message was sent by a unit in the middle of an operation in Europe that was on the move and unable to stop to use a radio message.

It also could have been a kind of training exercise, the BBC reports, even perhaps for D-Day.

So far, the public has been eager to try to help, according to the Mirror.

"We have had about 50 people getting in touch since our request for help was published yesterday, mainly by email but also some phone calls," a GCHQ representative told the paper.

"They have been of varying ages, from school kids to people who were alive in the war. There have been men and women, and not just from the UK - from Holland and the USA too. They're approaching it from different angles, but no one has come through with a solution, saying this is what it definitely means, so the quest continues. It's still early days," the rep added.

Retail's Winners Rely on the Service-Profit Chain - Tom Davenport ...

With Black Friday behind us, Cyber Monday upon us, and retail's make-or-break season in high gear, many of us are interacting more than usual with front-line service employees. And since it's also HBR's 90th birthday, some of us are thinking about the articles that have had the greatest impact over the years. What better moment to re-read "Putting the Service-Profit Chain to Work," which was originally published in 1994 and reprinted as a "classic" in 2008. The article, written by a leading group of service management thinkers (Jim Heskett, Tom Jones, Gary Loveman, Earl Sasser, and Len Schlesinger) is a great example of both the power a management idea can have, and how much work is required for an idea to become reality.

The basic idea of the service-profit chain (SPC) is that when organizations treat their employees well, they provide good service to customers. Customers then buy more, which improves revenues and profits. That gives the organization more resources, which it can use to improve employee and customer satisfaction even further. This virtuous cycle has been proven to work not only in retail but across the many service industries that have collectively become the core of every advanced economy.

The article is notable for a variety of reasons, some typical of best-selling HBR articles, and some quite distinctive. First, the typical attributes:

  • The concept requires sustained effort to implement successfully. Building employee engagement and customer satisfaction takes years of action across a variety of fronts: training, measurement, compensation, etc. (If there is a "do this and get rich quick" article in HBR, I haven't read it.)
  • For the ideas in the article to work, implementation has to be cross-functional. Human Resources, Sales and Marketing, and Operations?at least?need to be involved. Because so many functions are involved and because substantial resources need to be committed, it's normally the case that CEOs have to be engaged in the process. I've seen some efforts at implementing the SPC that have failed because no one was willing to bang enough heads to make the cross-functional collaboration happen.
  • This is a way of life, not an individual program. It requires long-term commitment to be successful. Organizations that shift priorities regularly?from customer orientation to cost-cutting, for example?will not fare well with it. Organizations that replace their leaders with new ones determined to make their mark with their own signature programs will not fare well with it.
  • Finally, it's also typical that even though the idea has been around for almost three decades, printed twice in HBR, and elaborated upon in several books, I regularly encounter executives in the service industry who haven't heard of it. I even ran into a CEO of a large retailer whose own company had successfully implemented SPC in the 90s, but who was totally unaware of it.

What's unusual about this HBR best-seller? Well, for one thing, some of the most successful implementers of the concept have been the co-authors themselves. Gary Loveman brought the idea to Harrah's (now Caesars Entertainment), and made that company the world's largest gaming firm. Len Schlesinger put the SPC to work at Limited Brands, where he was COO and Vice Chairman. Tom Jones has successfully employed many of the ideas at a number of Wendy's franchises he co-owns. The other two authors, Jim Heskett and Earl Sasser, remain active or semi-retired academics, but they certainly worked with a number of firms as individual consultants or advisors to the Service Profit Chain Institute.

The other unusual?and unfortunate?aspect of the SPC article is that the team that created it was largely disbanded at Harvard Business School. Schlesinger and Loveman became corporate executives, Jones became an entrepreneur, and Heskett took emeritus status at HBS; only Sasser remains a professor there. The "dream team" of service management was broken up, but the ideas live on and are available for application by anyone who's serious about employers, customers, and business success.

NEW YORK (Reuters) - A former SAC Capital portfolio manager was released on $5 million bail on Monday after making his first appearance in a New York court on charges of making illegal trades that hedge fund titan Steven A. Cohen personally signed off on.

Mathew Martoma, 38, of Boca Raton, Florida, was charged last week in what U.S. prosecutors called "the most lucrative" insider-trading scheme ever.

Martoma was accused of helping Cohen's firm avoid losses and reap profits totaling $276 million in the summer of 2008 by using insider tips he obtained from a doctor about Elan Corp and Wyeth LLC. Martoma worked for CR Intrinsic, a unit of Cohen's SAC Capital.

Cohen was not charged with wrongdoing, but prosecutors have said in court papers that the "owner" of the hedge fund signed off on Martoma's recommendation to sell the shares of Elan and Wyeth. A spokesman for SAC Capital said last week that "Mr. Cohen and SAC are confident that they have acted appropriately and will continue to cooperate with the government's inquiry."

At a 13-minute hearing in U.S. district court in Manhattan on Monday, Martoma spoke only once, answering "yes, your honor" to a judge's question. He did not enter a plea.

Magistrate Judge James Cott on Monday agreed to a proposed $5 million bail package for Martoma, who has been free on similar bail conditions since appearing in a Florida court after his arrest on November 20.

Charles Stillman, Martoma's lawyer, has said he is confident his client will be exonerated. Stillman told reporters gathered outside the courtroom Monday that "we took care of business today and we'll be back another day."

Martoma worked for CR Intrinsic in Stamford, Connecticut, until 2010. He is the fifth person associated with SAC Capital, one of the most influential hedge funds, to be charged with insider trading in either a criminal or civil proceeding.

In a criminal complaint, authorities said Martoma spoke in July 2008 to the "hedge fund owner" - Cohen - and recommended selling shares of Elan and Wyeth before a negative announcement on clinical trial results for an Alzheimer's drug jointly developed by the two companies.

U.S. securities regulators, who have filed civil insider-trading charges against Martoma, contend he obtained confidential tips from Sidney Gilman, who was chair of a committee to monitor patient safety during the Alzheimer's drug's clinical trial.

Gilman, an 80-year old neurology professor at the University of Michigan, is now cooperating with prosecutors after agreeing to pay a $186,781 disgorgement. A lawyer for Gilman declined comment last week.

The Securities and Exchange Commission complaint said Gilman worked as a consultant for a so-called expert network. Hedge funds use such networks to gain insight into various industries.

According to the criminal complaint, Gilman scheduled meetings and phone calls with Martoma that allowed him to pass on new information quickly about the drug trial.

The judge set a December 26 hearing for Martoma to return to court, but Stillman said he expected it to be pushed back to a later date.

The case is USA v. Martoma, U.S. District Court for the Southern District of New York, No. 12-mag-2985.

Flood insurance premiums, don't be too downhearted

I have been tracking the news today, hearing of the misery caused by the latest bout of flooding, yet the impasse regarding renewal of the Statement of Principles goes on without an imminent solution. I listened to a spokesperson from the Association of British Insurers (ABI) on BBC?s Today programme, he articulated what appears to me to be a perfectly sensible, pragmatic solution to the challenge of affordable property insurance in high-risk areas, yet the Government is hell-bent on saving money and don?t seemingly get the big picture.

The ABI proposal of a temporary government overdraft for the insurance industry seems perfectly reasonable in the circumstances (especially when compared to the level that the government had to dip it?s hand in it?s pocket to bail out the greedy banks), what annoys me is that the ABI proposal is based on a premium levy to create a pot, or fund help cover flooding in the future ? so policyholders (not Mr Cameron & co) ultimately paying.

This impasse will run and run, no doubt into the spring and beyond and as a result more and more people growing increasingly concerned about the availability and affordability of property insurance, and rumors aplenty that areas of the country could be uninsurable without a solution in place between the Insurers and the Government.

LOS ANGELES (AP) ? The postgame roars from Notre Dame's locker room echoed right through the Coliseum's thick cement walls and metal beams Saturday night, moving around the 89-year-old arena like a long-absent force of nature.

After decades away, the Fighting Irish are back on top of college football ? unmatched in the rankings, unblemished in the standings, and unequivocally ready for a chance to end a 24-year national championship drought.

Manti Te'o, the star linebacker from Hawaii who led this improbable revival season, took a moment to listen to those echoes.

"This is where you want to be when you go to Notre Dame," he said.

The Irish are No. 1 again ? a Golden Dome atop their sport.

Notre Dame (12-0) beat Southern California 22-13 to complete its first unbeaten regular season since 1988. That's also the last championship year for the school that produced a legion of the sport's most memorable figures: Knute Rockne, the Four Horsemen, Paul Hornung, Joe Montana ? heck, even Rudy Ruettiger.

A no-nonsense win over Notre Dame's intersectional rivals in Los Angeles capped a year of historic dominance for a defense led by Te'o, its inspirational Heisman contender. That defense allowed just nine touchdowns all season long, capped by four downs of unyielding play while backed up to its goal line by the Trojans in the final minutes.

"You just put the ball down in front of us, and if there's time on the clock, we're never going to give up," defensive end Kapron Lewis-Moore said.

These Irish never flinched, either in dire late-game circumstances or under the weight of history that has crushed decades of previous Notre Dame teams. After beginning the year unranked and projected for maybe eight victories by optimistic pundits, the Irish produced a marvelous season of old-fashioned, hard-nosed football amid the wacky spread offenses and garish neon uniforms that seem to dominate the sport these days.

After winning half of their games by nine points or fewer, including two hair-raising escapes in overtime, it's clear these Irish have something else going for them as well.

"Not saying it was lucky, but luck doesn't hurt," said Terry Brennan, who played at Notre Dame in the late 1940s and coached the team from 1954-58. "The point is, they got the break and they took advantage of it. That's the key."

The Irish have six weeks to prepare for the BCS title game on Jan. 7, but coach Brian Kelly's restoration of the Notre Dame mystique could linger much longer.

The Golden Dome atop Notre Dame's administration building has regained its luster at a school where coaches Bob Davie, Tyrone Willingham and Charlie Weis all failed to restore the program to its most recent glory under Lou Holtz in the late 1980s. All told, Notre Dame lost at least three games every season between 1993 and this fall ? not bad, but not good enough to contend for national titles.

Athletic Director Jack Swarbrick, a Notre Dame alum, said when he took the job in 2008 he found no reason Fighting Irish football could not be great again.

"I became convinced there weren't any insurmountable hurdles, institutional hurdles, something in our approach or our system that made it so we could never be this successful again," he said in a phone interview Sunday.

Just three years after taking over a 6-6 team with ancient expectations annually dwarfed by the modern realities of competing at a Catholic school in frigid northern Indiana with tough academic standards, Kelly has put the Irish back on top.

"One of the things I really wanted in a coach was somebody who ... would be a CEO coach," said Swarbrick, who hired Kelly to replace Weis. "I think what you're seeing in this third year is the maturation of that staff into a really cohesive unit."

And though he's still one win shy of ultimate success, Kelly did it in his third year ? the same season in which Frank Leahy, Ara Parseghian, Dan Devine and Holtz all won national titles during their tenures at Notre Dame.

"It's easy to say, 'Well, yeah, I'm surprised,'" Kelly said. "But when you go in that locker room and are around the guys I'm around, you're not surprised. The commitment they've made ? they've done everything I've asked them to do. It doesn't surprise me anymore."

Thousands of Irish fans turned up at the Coliseum for the regular-season finale, demonstrating the wide reach of Notre Dame's appeal. The Irish have embraced their status as an international program in recent years, playing everywhere from Yankee Stadium to Dublin, Ireland, while Kelly put the ingredients in place for this season's success.

Swarbrick acknowledges he expected the Irish to need maybe one more year to contend at an elite level.

"I knew we were much, much better, but frankly I thought the schedule might mask the progress," he said.

Although Notre Dame's defense was clearly tough, nobody could have expected such success from an offense now led by the likes of quarterback Everett Golson, who redshirted last year, and tailback Theo Riddick, who was a slot receiver last season.

The Irish were nobody's favorite, but they've ended up on top. The 84-year-old Brennan, who was just 25 when he took over the Irish program in 1954, knows all about the importance of seizing the moment.

"Grab it when you can," he said. "Next year you might have injuries, and the ball bounces the other way."

The Irish returned home Sunday knowing they've still got a bit of work to do ? and if their season to date is any indication, they're still hungry.

Notre Dame is likely to be an underdog to an opponent from the Southeastern Conference in the BCS title game. The Irish will rely on the experience of their unbeaten season, the history of past champions wearing their uniforms, and the support of untold millions who love what the team once represented ? and what it means again.

Te'o, who turns 22 in January, hadn't been born the last time Notre Dame won a national title. He still knows the date of the last Irish national championship by heart, thanks to the sign at the end of the tunnel at Notre Dame Stadium where he steps on that hallowed field each game day.

"I'm just hoping that we can add our year to it," Te'o said. "But it's going to take a lot of work."

NC State fires O'Brien after 6 seasons

RALEIGH, N.C. (AP) ? North Carolina State has fired football coach Tom O'Brien after six seasons, four of which were good enough to get the Wolfpack into a bowl but none that could get them to the Atlantic Coast Conference championship game.

Athletic director Debbie Yow made the announcement Sunday, one day after the Wolfpack finished a 7-5 regular season with a win over Boston College.

O'Brien went 40-35 after coming to Raleigh from BC following the 2006 season. He took the Wolfpack to three bowl games, but won't coach in a fourth when N.C. State receives its bid next week.

N.C. State says offensive coordinator Dana Bible will be the interim coach for the bowl game. All other assistants are staying to continue bowl preparations.

"I appreciate the opportunity to have coached at North Carolina State University and I feel that the program is in a better place now than when I started," O'Brien said in a statement issued by the school.

The 64-year-old O'Brien, who went 75-45 in 10 seasons at BC with eight consecutive bowl berths before coming here, said at his December 2006 hiring that it was "N.C. State or bust for me."

In his statement Sunday, O'Brien said he is looking "forward to life after football."

His teams were just 22-26 in ACC play and finished above .500 in the league just once, going 5-3 in 2010. He was 1-14 in Atlantic Division road games.

Only three ACC teams ? No. 13 Florida State (10-2), No. 15 Clemson (10-2) and rival North Carolina (8-4) ? had better overall records this season than the Wolfpack, who were 4-4 in the league.

That was good for third in the Atlantic Division behind Florida State and Clemson ? exactly where they were picked in the preseason poll.

But consistency was a problem all season.

They opened with a 14-point loss to a Tennessee team that went on to finish 5-7. They blew a late 10-point lead and allowed an ACC-record 566 yards passing in a loss at Miami. They were routed at home 33-6 by a last-place Virginia team that had lost six straight and they gave up 62 points in a loss at Clemson.

Not even a thrilling upset of then-No. 3 Florida State on Oct. 6 could save O'Brien's job.

O'Brien also faced some questions in the spring of 2011, when he parted ways with three-year starting quarterback Russell Wilson, who was attempting to play both minor-league baseball and football at the high FBS level.

Wilson transferred to Wisconsin for his senior season, led the Badgers to the Rose Bowl and wound up winning the job with the Seattle Seahawks.

O'Brien's choice certainly appeared justified when Mike Glennon ? who took over for Wilson ? led the ACC in passing this season, averaging 304 yards.

The school says a national search for O'Brien's replacement will begin immediately.

The case is one of two patent infringement lawsuits pending in the U.S. District Court in San Jose by Apple against Samsung. An earlier lawsuit by Apple that related to different patents resulted in a $1.05 billion jury verdict against Samsung on Aug. 24.

Apple is also seeking to add the Samsung Galaxy S III, running the new Android "Jelly Bean" operating system, the Samsung Galaxy Tab 8.9 Wi-Fi, the Samsung Galaxy Tab 2 10.1, the Samsung Rugby Pro, and the Samsung Galaxy S III Mini, to its lawsuit, according to a court filing on Friday.

"Apple has acted quickly and diligently to determine that these newly-released products do infringe many of the same claims already asserted by Apple," the company said in the filing.

Samsung representatives did not immediately respond to requests for comment.

Apple filed the second lawsuit in February, alleging that various Samsung smartphone and tablet products including the Galaxy Nexus infringed eight of its patents.

Samsung denied infringement and filed a cross-complaint alleging that Apple's iPhone and iPad infringed eight of its patents.

A U.S. judge on Nov. 15 allowed Samsung to pursue claims the iPhone?5 also infringes its patents.

The case is Apple Inc. v. Samsung Electronics Co., Ltd. et al, No. 12-cv-00630.
